"He's Not 5 Minutes Loyal"


Stephen Colbert's opening monologue last night covered the impending talks between Korean dictator Kim Jong-Un and unfit incompetent Donald "Rump" Trump ("let's get ready to bumble!"), and speculation over Rump fixer Michael "Clown Roy Cohn" Cohen ("man who's definitely seen the Trump sex tape") flipping on his boss pretty quickly. Classic Colbert.

A bit off subject so forgive me up front.
A am also NOT a lawyer thou sometimes I play like one on the internet ;)

I have signed some NDA's in the past usually only 3 to 6 months duration for specific event. So a, at best, nodding acquaintanceship with them.

My limited understanding of NDA's is that they can NOT be used to hide a crime.
Granted they have been used and abused and companies such as Monsanto, Joint venture fisheries/processing companies and BP have probably gotten away with this but by law the mafia can NOT use a NDA to prevent a get away driver from cutting a deal to testify about a murder.
If this is correct plus then having the lawyer who drew up the NDA while he was representing a party, or even a party to it himself, claim he can NOT testify/ argue in support of the NDA he drew up because of his 5th amendment rights against self incrimination.
Would this not go a long ways towards undercutting the argument that the actions around that NDA are within the realm of legal activity and can be hidden behind a NDA?
That the one person who should know this document better then anyone else is asking for a delay on the argument about enforcement of a very biased arbitration clause for fear of self incrimination seems a bit dodgey to me.
Like the third prophecy of Lourdes it just makes me more curious.
Any legal eagles who know more then I ( easy) care to enlighten me on this?
Please show me the error of my ways.
