Manhattan DA's Office Replies To "Gym" Jordan




Ohio's far-right zealot and protector of locker room predators Rep. Jim "Gym" Jordan wants to serve his cult leader the Malignant Loser so badly that he wants to obstruct the porn star hush money case by the Manhattan District Attorney's office. Gym sent a letter to the Manhattan DA on March 20 seeking confidential information about the case obviously in order to sabotage the proceeding against the Malignant Loser. In response, the District Attorney's General Counsel Leslie Dubeck fired a letter back to Gym, schooling him in exquisite detail on the impropriety and illegality of his demands. Some excerpts, with our emphasis bolded:

"Your letter dated March 20, 2023 (the Letter), in contrast, is an unprecedented inquiry into a pending local prosecution. The Letter only came after Donald Trump created a false expectation that he would be arrested the next and his lawyers reportedly urged you to intervene. Neither fact is a legitimate basis for congressional inquiry."

 And:

"These are quintessential police powers belonging to the State, and your letter treads into territory very clearly reserved to the states. It suggests that Congress's investigation is being "conducted solely for the personal aggrandizement of the investigators or to punish those investigated and is, therefore, indefensible." Watkins v. United States, 354 U.S. 178, 187 (1957).  [snip]

The Letter seeks non-public information about a pending criminal investigation, which is confidential under state law."

And, with a nice slap at Gym by invoking the right wing's cherished Tenth Amendment:

"The Letter's requests are an unlawful incursion into New York's sovereignty. Congress's investigative jurisdiction is derived from and limited by its power to legislate concerning federal matters. [snip]

The Constitution limits Congress's powers to those specifically enumerated; and the Tenth Amendment ensures that any unenumerated powers are reserved to the States."

There's more legal schooling of Gym and justifications for tossing his demands in the waste basket in General Counsel Dubeck's stinging letter. No doubt he'll have conniptions and point to the response as evidence of "weaponizing" law enforcement, ending up with nothing but a little gold star from the Malignant Loser for his attempt at obstructing the porn star hush money case.
