Today, a three judge panel of the Circuit Court of Appeals for the District of Columbia will hear the Government's case for denying immunity to the Malignant Loser for his attempts to overturn the 2020 election, including a violent insurrection on January 6. The Malignant Loser will be present, apparently in an effort to glower at and intimidate the judges. A strong rainstorm during the day in Washington will likely dampen his usual rants on the courthouse steps. From the New York Times:
"The hearing in front of a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit could help decide when — or even whether — Mr. Trump will go to trial in the election interference case, which is unfolding in Federal District Court in Washington, just downstairs from where the appeals court sits. It could also go a long way in determining the timing of the three other criminal trials that Mr. Trump is facing in the months ahead.
Adding yet another jolt to the hearing, the former president has said on social media that he plans to attend it in person even though he is not required to be there and appellate judges often prefer to hear cases as intellectual exercises without the presence of defendants. Mr. Trump’s appearance is a further sign of just how much he has placed fighting his criminal prosecutions at the heart of his political strategy heading into the Republican primary campaign." He's already falsely claiming that President Biden is forcing him to attend, keeping him off the campaign trail. His cult buys the Malignant Loser's argument that these court trials are "election interference," despite the fact that he chose to run in November 2022, months after it became apparent that he faced legal jeopardy in various jurisdictions (D.C., New York, Georgia, and perhaps more).
Most legal authorities believe that the Malignant Loser's case is fatally flawed, and that the panel will fairly quickly rule that he does not have immunity. The Special Counsel's case before District Court judge Tanya Chutkan is on hold pending the upper court's ruling.
BONUS: On Sunday night, Judge Chutkan was the victim of a "swatting" call, causing a SWAT team to respond to her home believing a shooting had occurred. That the caller was a Trump cultist is beyond doubt, and we hope justice will be served on them.
BONUS II: The U.S. Court of Appeals, Second Circuit, ruled yesterday for the second time that the Malignant Loser did not have presidential immunity in the E. Jean Carroll defamation case.
