Likely feeling intense pressure after Special Counsel Jack Smith challenged her latest attempt to delay and rig the classified documents case in favor of her patron, Federal District Judge and MAGA incompetent Aileen Cannon ruled today that the Presidential Records Act did not permit him to retain highly classified documents. Cannon still has multiple decisions that she's been sitting on that need to be decided before trial. From the Washington Post:
"Trump’s defense team argued the Presidential Records Act took priority over the Espionage Act when it came to highly classified documents that he took to his private residence in Florida after his presidency. On Thursday, Cannon shot down that argument, saying the PRA “does not provide a pre-trial basis to dismiss” either the mishandling charges or the related obstruction charges against Trump.
The decision comes two days after special counsel Jack Smith made a court filing saying the judge was pursuing a legal premise about the PRA that was 'wrong,' and urged her to rule, adding that if she decided otherwise, he wanted to appeal any such decision quickly." (our emphasis)
"Pre-trial basis to dismiss." It doesn't provide any basis actually, pre-trial or anytime. But she's keeping her options open, apparently. She also may have read the tea leaves with the 11th Circuit Court of Appeals, which reversed her earlier in this case, and to which Special Counsel Smith was ready to file a writ of mandamus to force her hand on this and other decisions. Whatever her motivation, be assured she'll do everything to delay and undermine the Justice Department's case, one that is the most straight forward of the cases now pending against the Malignant Loser in multiple jurisdictions.
