Special Counsel Smith Appeals Biased Ruling




As expected, Special Counsel Jack Smith has filed a notice appealing the outrageous ruling of Trump-appointed fangirl Judge Aileen Cannon's dismissal of the classified documents and obstruction case against the Malignant Loser and his co-conspirators. The case was considered a "slam dunk" for Federal prosecutors, who caught the Malignant Loser in possession of highly classified documents after he left office, mishandling their storage, and obstructing official requests that they be returned. Cannon has tried to run out the clock on this case out for months and months, not ruling on basic motions and siding with Trump's delaying motions on many others. From CNBC:

"Smith's appeal, which was expected, will be heard in the 11th Circuit U.S. Court of Appeals in Atlanta, which reviews cases arising from Florida federal courts.

Cannon on Monday tossed out the case against Trump and two co-defendants, ruling that Smith's appointment to prosecute cases involving the former president violated the appointments clause of the U.S. Constitution.

Trump was charged in the case filed in Florida Southern District Court with retaining hundreds of classified government documents at his Mar-a-Lago club residence after leaving the White House in January 2021, and with trying to hide them from government officials who sought their return. [snip]

The appeal is likely to end up at the U.S. Supreme Court, regardless of how the 11th Circuit appeals court rules."

The 11th Circuit has reversed Cannon in the past on this case, and may do so on this motion, given the widely-established legal precedent for the appointment of special counsels. The wild card would be the Republican MAGA-dominated Supreme Court, which has been protecting the Malignant Loser in recent opinions. Regardless, the case won't be heard -- if ever -- until after the November elections.
