The Good, The Bad, And The Ugly

 

The good:

A federal judge has reimposed limits on former president Donald Trump’s public statements in advance of his trial on charges of conspiring to subvert the results of the 2020 election.

U.S. District Judge Tanya S. Chutkan on Sunday evening put back in place an order she had lifted nine days earlier to give Trump and U.S. prosecutors more time to argue whether the restrictions were unconstitutional, as attorneys for the former president had claimed. Trump can now ask a higher court for an emergency stay pending appeal, but in the meantime he is bound by Chutkan’s limits. If Trump violates the gag, as he did a similar order by a state judge in New York, Chutkan will have to decide how to punish the former president and leading presidential candidate.  [snip]

Under the existing order Trump and all interested parties in the case are barred from making or directing others to make public statements that “target” individual attorneys, witnesses, “any reasonably foreseeable witness,” or court staff involved in the case or the substance of their testimony. While the order was on hold, Trump posted a comment on social media calling special counsel Jack Smith “deranged” and saying former chief of staff Mark Meadows would be a lying coward if he testified for the prosecution. Both comments involved some of the exact type of language Chutkan deemed out of bounds.

Trump appeared to potentially to violate Chutkan’s order 75 minutes after she gave notice that it was reinstated, attacking his former attorney general and potential witness, William P. Barr.

“I called Bill Barr Dumb, Weak, Slow Moving, Lethargic, Gutless, and Lazy, a RINO WHO COULDN’T DO THE JOB,” Trump said in part of an 88-word post on his social media platform that both belittled the man he chose to serve as the nation’s top law-enforcement officer and exaggerated his crowd sizes. “So now this Moron says about me, to get even, ‘his verbal skills are limited.’ Well, that’s one I haven’t heard before. Tell that to the biggest political crowds in the history of politics, by far. Bill Barr is a LOSER!”

About 19 minutes after his post about Barr, Trump complained on social media: “The Corrupt Biden administration just took away my First Amendment Right To Free Speech.”

We want the s.o.b. to suffer some consequences for a change.  F.A.F.O.

The bad:

All or most of a $267,000 loan obtained by Supreme CourtJustice Clarence Thomas to buy a high-end motorcoach appears to have been forgiven, raising tax and ethics questions, according to a new report by Senate Democrats.

Anthony “Tony” Welters, a longtime friend of Thomas who made the loan in 1999, forgave the debt after nine years of what he called interest-only payments, says the report, which was released Wednesday by Democrats on the Senate Finance Committee.  [snip]

Thomas borrowed the money from Welters, a healthcare executive, to buy a 40-foot refitted tour bus in which he tours the country with his wife, Ginni. Thomas has talked about staying in Walmart parking lots and RV parks, which are “what the neighborhoods used to be like.”

At the time of the loan, Thomas said in a handwritten note on his Supreme Court letterhead that agreements to pay interest of 7.5% a year and repay the money in five years, the report says. In 2004, the time to repay the loan was extended until 2014.

Documents voluntarily provided by Welters to the committee show that he forgave the loan in 2008, the report says. Welters gave the committee a copy of just one payment of $20,042 that Thomas made, in 2000.

“Welters forgave the balance of the loan to Thomas in recognition of the payments made by Thomas which Welters characterized as interest only payments that exceeded the amount of the original loan,” the report says. Nine years of interest-only payments would total roughly $180,000, considerably less than the loan amount. Welters did not explain the discrepancy...

We have six justices, all Republican, who are liars (saying they'd uphold precedent on Roe, but then overturning it) and religious zealots, one who was a serial sexual assaulter, and at least two who've taken money or favors from billionaire patrons.  The stench is overwhelming.

The ugly: 

At least 48 people died when Category 5 Hurricane Otis slammed into Mexico’s southern Pacific coast, most of them in Acapulco, Mexican authorities said Sunday as the death toll continued to climb and families buried loved ones.

Mexico’s civil defense agency said in a statement that 43 of the dead were in the resort city of Acapulco and five in nearby Coyuca de Benitez. Guerrero state’s governor had earlier raised the number of missing to 36 from 10 a day earlier. The death toll increased after authorities had raised it to 39 on Saturday.

In Acapulco, families held funerals for the dead on Sunday and continued the search for essentials while government workers and volunteers cleared streets clogged with muck and debris from the powerful Category 5 hurricane.

Katy Barrera, 30, said Sunday that her aunt’s family was buried under a landslide when tons of mud and rock tumbled down onto their home. Her aunt’s body was found with the remains of their three children ranging in age from 2 to 21. Her uncle was still missing. Separately, Barrera’s own mother and brother also remained missing.

“The water came in with the rocks, the mud and totally buried them,” Barrera, who was standing outside a local morgue, said of her aunt’s family.

On Sunday, authorities released the bodies of her aunt and the two youngest children to relatives. Bodies in white bags were loaded into open caskets in the back of hearses. The eldest daughter had already been buried the day before...

Otis went to a Category 5 hurricane so fast it caught everyone by surprise, leading to people sheltering in place instead of evacuating.  Now rescue efforts are being hampered by the damage to the infrastructure and the magnitude of the destruction.

Clarence Thomas' Shady Defense For Luxury Gifts




After ProPublica's explosive report that corrupt right-winger "Justice" Clarence Thomas had been given unreported luxury gifts over a span of decades by a billionaire Republican donor, Thomas attempted to defend himself. It was not convincing. From the Associated Press:

"Supreme Court Justice Clarence Thomas said Friday he was not required to disclose the many trips he and his wife took that were paid for by Republican megadonor Harlan Crow.

Describing Crow and his wife, Kathy, as 'among our dearest friends,' Thomas said in a statement that he was advised by colleagues on the nation’s highest court and others in the federal judiciary that 'this sort of personal hospitality from close personal friends, who did not have business before the Court, was not reportable.' Thomas did not name the other justices or those in the judiciary with whom he had consulted." (our emphasis)

He didn't name the other justices because there likely were none. The "personal hospitality from close personal friends" phrasing used by Thomas is an ethics loophole that he wants the gullible to accept. However, here's a sample of the "personal hospitality" that Thomas and his loopy seditionist wife received:

"Thomas, 74, and his wife, Virginia, have traveled on Crow’s yacht and private jet as well as stayed at his private resort in New York’s Adirondack Mountains, ProPublica reported. A 2019 trip to Indonesia the story detailed could have cost more than $500,000 had Thomas chartered the plane and yacht himself."

We suspect there are other "close personal friends" who have been showering the right-wing justice and his spouse with unreported "personal hospitality" over the years to keep him on a short leash. Those will be the next shoes to drop.

 Legal ethics experts weren't buying Thomas' lame excuse for decades of receiving lavish gifts:

"New York University law professor Stephen Gillers, an authority on legal ethics, said Thomas’ statement 'is an abdication of his responsibility' under ethics guidelines.

'Thomas is shamelessly seeking to shift the blame for his failure to report Crow’s princely hospitality to advice he allegedly received from other Justices when he joined the court more than 30 years ago. Most of them are now dead and, conveniently, cannot contradict him,' Gillers wrote in an email.

Charles Geyh, a law professor at Indiana University who studies judicial ethics, wrote in an email that he doubts any justice would have advised Thomas against disclosure if he had laid out the details in ProPublica’s report, 'hundreds of thousands of dollars in luxurious travel and accommodations at exotic locales spanning decades, from a benefactor who has a deeply rooted partisan and ideological interest in the future of the Court on which the justice sits.'”  (our emphasis)

The ethical course for Thomas would have been to report the gifts even if he believed they weren't subject to disclosure. But he hid them because he knew they were a problem. Now, let's see what other problems he has.

The Ethically Compromised Justice Thomas (Cont.)

 


 

It seems Republican Supreme Court "Justice" Clarence Thomas and his coup- plotting nutball wife have been enjoying the largesse of a billionaire Republican donor for years ... without bothering to report it.  ProPublica has the goods:

In late June 2019, right after the U.S. Supreme Court released its final opinion of the term, Justice Clarence Thomas boarded a large private jet headed to Indonesia. He and his wife were going on vacation: nine days of island-hopping in a volcanic archipelago on a superyacht staffed by a coterie of attendants and a private chef.

If Thomas had chartered the plane and the 162-foot yacht himself, the total cost of the trip could have exceeded $500,000. Fortunately for him, that wasn’t necessary: He was on vacation with real estate magnate and Republican megadonor Harlan Crow, who owned the jet — and the yacht, too.

For more than two decades, Thomas has accepted luxury trips virtually every year from the Dallas businessman without disclosing them, documents and interviews show. A public servant who has a salary of $285,000, he has vacationed on Crow’s superyacht around the globe. He flies on Crow’s Bombardier Global 5000 jet. He has gone with Crow to the Bohemian Grove, the exclusive California all-male retreat, and to Crow’s sprawling ranch in East Texas. And Thomas typically spends about a week every summer at Crow’s private resort in the Adirondacks.

The extent and frequency of Crow’s apparent gifts to Thomas have no known precedent in the modern history of the U.S. Supreme Court.

These trips appeared nowhere on Thomas’ financial disclosures. His failure to report the flights appears to violate a law passed after Watergate that requires justices, judges, members of Congress and federal officials to disclose most gifts, two ethics law experts said. He also should have disclosed his trips on the yacht, these experts said. [snip]

Through his largesse, Crow has gained a unique form of access, spending days in private with one of the most powerful people in the country. By accepting the trips, Thomas has broken long-standing norms for judges’ conduct, ethics experts and four current or retired federal judges said.

“It’s incomprehensible to me that someone would do this,” said Nancy Gertner, a retired federal judge appointed by President Bill Clinton. When she was on the bench, Gertner said, she was so cautious about appearances that she wouldn’t mention her title when making dinner reservations: “It was a question of not wanting to use the office for anything other than what it was intended.”

Virginia Canter, a former government ethics lawyer who served in administrations of both parties, said Thomas “seems to have completely disregarded his higher ethical obligations.”  [snip]

Thomas’ approach to ethics has already attracted public attention. Last year, Thomas didn’t recuse himself from cases that touched on the involvement of his wife, Ginni, in efforts to overturn the 2020 presidential election. While his decision generated outcry, it could not be appealed.   (our emphasis)

There's practically no one in the Federal Government more deserving of impeachment and removal than this stain on the judiciary.  But, of course, we have a Senate full of Republican enablers who refused to convict the twice- impeached criminal Malignant Loser, so nothing will be done to Thomas -- which is what he is counting on.  When you have a lifetime appointment and a lawless party has your back, this corruption, sense of entitlement and impunity is what you get.

The Ginni Thomas Affair

 


The fact that Ginni Thomas, wife ("best friend") of Supreme Court Justice Clarence Thomas , is a certifiable, Christofascist crank is a well- known fact.  That she actively sought the intervention of the Malignant Loser's Chief of Staff to overturn the legitimate 2020 election is now added to that fact base.

Here's part of Bob Woodward and Robert Costa's blockbuster reporting in the Washington Post: 

Virginia Thomas, a conservative activist married to Supreme Court Justice Clarence Thomas, repeatedly pressed White House Chief of Staff Mark Meadows to pursue unrelenting efforts to overturn the 2020 presidential election in a series of urgent text exchanges in the critical weeks after the vote, according to copies of the messages obtained by The Washington Post and CBS News.

The messages — 29 in all — reveal an extraordinary pipeline between Virginia Thomas, who goes by Ginni, and President Donald Trump’s top aide during a period when Trump and his allies were vowing to go to the Supreme Court in an effort to negate the election results.

On Nov. 10, after news organizations had projected Joe Biden the winner based on state vote totals, Thomas wrote to Meadows: “Help This Great President stand firm, Mark!!!...You are the leader, with him, who is standing for America’s constitutional governance at the precipice. The majority knows Biden and the Left is attempting the greatest Heist of our History.”

When Meadows wrote to Thomas on Nov. 24, the White House chief of staff invoked God to describe the effort to overturn the election. “This is a fight of good versus evil,” Meadows wrote. “Evil always looks like the victor until the King of Kings triumphs. Do not grow weary in well doing. The fight continues. I have staked my career on it. Well at least my time in DC on it.”

Thomas replied: “Thank you!! Needed that! This plus a conversation with my best friend just now… I will try to keep holding on. America is worth it!”

"Best friend" is how the Thomases refer to each other (not "Long Dong Silver"?). 

The text messages were among 2,320 that Meadows provided to the House select committee investigating the Jan. 6 attack on the U.S. Capitol. The content of messages between Thomas and Meadows — 21 sent by her, eight by him – has not previously been reported. They were reviewed by The Post and CBS News and then confirmed by five people who have seen the committee’s documents.

The fact that Ginni Thomas' damning texts would be included in the documents requested by the House Select Committee would obviously be known to Justice Thomas.  He acted accordingly:

 

 

 

The Woodward/Costa piece is a fascinating look into the ways key players in the fever swamps surrounding the re-election campaign of the Malignant Loser were operating to (to coin a phrase) steal the election -- specifically the question of Ginni Thomas' influence over her husband's decisions on the Court pertaining to the Malignant Loser.  It's almost certain more will come out on the "best friends" corrupt use of their positions.

BONUS:  She left no doubt she's a raving loon --
