Sunday Reflection: "Full Of Passionate Intensity"

"Turning and turning in the widening gyre

The falcon cannot hear the falconer;

Things fall apart; the centre cannot hold;

Mere anarchy is loosed upon the world,

The blood-dimmed tide is loosed, and everywhere

The ceremony of innocence is drowned;

The best lack all conviction, while the worst

Are full of passionate intensity."

-- the first stanza of "The Second Coming," by Nobel Prize winning Irish poet and dramatist W.B. Yeats (6/13/1865 - 1/28/1939), written in 1919 just after the end of World War I and as Ireland's war of independence from Britain was beginning. It reflected a sense that the world was spinning out of control and into a totalitarian world led by "the worst... full of passionate intensity." The second stanza of the poem describes a "second coming" of that dark world, asking in that famous line, "what rough beast, it's hour come round at last, Slouches toward Bethlehem to be born?" Twenty years later, World War II in Europe began with Hitler's invasion of Poland.

In these times, we're facing a resurgence of far-right, fascistic movements around the world, not the least of which is represented here by the Malignant Loser and his MAGA cult following, the worst, "full of passionate intensity" as fascism's adoring followers were 85 years ago. They were defeated then, and they must be now.

Special Monitor Flags Trump Tax Evasion Plot

The Special Monitor appointed to oversee the New York civil case against the Malignant Loser has flagged a scheme that the Malignant Loser used to knowingly and intentionally evade as much as $48 million in taxes.  The findings have now been provided to Justice Arthur Engoron as he determines the penalties he'll impose on the fraudster and his criminal organization:

Tucked into a footnote in a letter written by former federal judge Barbara Jones, the court-appointed special monitor overseeing Donald Trump's New York business fraud case is a bombshell that appears to indicate the former president may have engaged in massive tax evasion, according to a new report released by The Daily Beast.

The letter, first reported by The Messenger, was delivered Friday to update Manhattan Supreme Court Justice Arthur Engoron on Jones' findings while reviewing the former president's business dealings through his company, the Trump Organization.

In it, Jones writes that the financial information filed to her by Trump's team has contained "incomplete" or "inconsistent" disclosures containing multiple "errors." However, she describes Trump and his businesses as "cooperative" with her investigation.

But buried in the sixth footnote of the 12-page letter is what the Daily Beast indicated is a clue that Trump may have evaded taxes on $48 million in income, with Jones writing that the massive sum — which Trump has claimed for years that he owes as a debt to one of his companies — never existed.

"When I inquired about this loan, I was informed that there are no loan agreements that memorialize the loan, but that it was a loan that was believed to be between Donald J. Trump, individually, and Chicago Unit Acquisition for $48 million," Jones wrote.

She added: "However, in recent discussions with the Trump Organization, it indicated that it has determined that this loan never existed — and thus that it would be removed from any upcoming forms submitted to the Office of Government Ethics (OGE) and would also be removed from subsequent versions of MAML," Jones wrote, referring to corporate financial statements filed by the company.  [snip]

However, per the Daily Beast, as recently as October, Trump has claimed in financial disclosures that he owes the sum to his company, Chicago Unit Acquisition LLC, listing his debt as more than $50 million.

The discrepancies, if true, would indicate that the disclosures Trump has filed with the federal government were intentionally submitted with inaccuracies related to the debt equating to tens of millions of dollars. "It would appear, assuming Judge Jones' letter is accurate, that this amounts to tax evasion," Martin Lobel, a tax lawyer, told The Daily Beast.

Of course, the broad outline of the Malignant Loser's tax evasion techniques has been known for some time:

[I]n 2019, Mother Jones reported a significant portion of Trump's debt was forgiven by the hedge fund he owed money to after he paid about half of it.

So, instead of paying income taxes of up to 39% on the forgiven debt, the outlet reported, Trump "invented a loan — and then parked it." Debt parking is the process of purchasing debt using a corporation to avoid paying income taxes on it. The maneuver is legal as long as the borrower intends to repay the loan but is illegal to engage in indefinitely.

Adam Levitin, a Georgetown University law professor specializing in commercial real estate finance, told Mother Jones at the time that the plot was "pretty brazen," adding: "if he didn't actually buy the loan, this is just garden-variety fraud."

"While the reasons behind claiming this fake loan are still unknown, at the very least he misled the government for years about his finances," Jordan Libowitz, communications director at Citizens for Responsibility and Ethics in Washington, told The Daily Beast. "It appears that Trump knowingly and intentionally broke the law. The only question is how many laws."

Adding the amount of taxes evaded, along with interest and penalties, along with the $370 million New York is already seeking in penalties, the $83 million Carroll defamation judgement, and Manhattan DA Bragg's pending business fraud/ mistress payoff trial -- all in State courts, where he can delay but can't nullify the results -- should be sufficient to eventually cause the Malignant Loser to have to sell off significant chunks, if not all, of his properties.  It also means, the sociopathic narcissist will  be ranting about nothing else but himself from now until Election Day, if he gets that far without being DQed or pulling a stint in the slammer (a.k.a., the American Dream).

And, contrary to the Malignant Loser's latest whine, This Is America.

Giuliani Bankruptcy Filing Says Trump Owes Him

In filing for Chapter 11 bankruptcy to avoid his obligation to pay Georgia election workers Shaye Moss and Ruby Freeman for continually defaming them, disgraced sleazy chud Rudy "Four Seasons Landscaping" Giuliani indicates in his paperwork that the Malignant Loser owes him fees for legal "work":

"Rudy Giuliani opened up his finances to a bankruptcy court — and the world — for examination on Friday, revealing that among his assets are three New York Yankees World Series rings, dozens of watches, and a potential claim against Donald Trump.

Giuliani listed a 'possible claim for unpaid legal fees against Donald J. Trump' in a schedule cataloguing his finances.

The former New York City mayor has represented Trump in several of his legal imbroglios and on various other unsavory missions. In 2019, Trump tasked Giuliani with digging up (or manufacturing) dirt on the Bidens; in 2020, Giuliani spearheaded Trump’s legal efforts to stay in power after having lost the election. [snip]

Throughout, Giuliani has reportedly begged Trump to cover his legal bills. The former President has reportedly not acquiesced."  (our emphasis)

We're savoring the beautiful timing and irony of this situation. The Malignant Loser not only has E. Jean Carroll's massive judgement against him to deal with, but now he has his loyal bootlicker Giuliani (or more accurately, his bootlicker's creditors) to stave off. It's all because Giuliani aped his deadbeat client's bald lies, conspiracies and accusations for years, willingly and with malice. The fact that he / his creditors will need to stand in line behind Ms. Carroll to collect from his cult leader client is perfect. Just make sure Shaye Moss and Ruby Freeman get some of the Malignant Loser's dough he owes to Giuliani.

Trader Joe's Says Labor Board "Unconstitutional"

Trader (Traitor?) Joe's is going full 19th Century unregulated capitalism on us:

Trader Joe’s is facing a litany of union-busting charges before the National Labor Relations Board. The agency’s prosecutors have accused the company of illegally retaliating against workers, firing a union supporter and spreading false information in an effort to chill an organizing campaign.

But in a hearing last Tuesday, the grocer’s attorney briefly summarized a sweeping defense it intends to mount against the charges: The labor board itself, which was created during the New Deal and has refereed private-sector collective bargaining for nearly 90 years, is “unconstitutional.”

The argument would appear to fit inside a broader conservative effort to dismantle the regulatory state, which has taken aim at agencies tasked with enforcing laws to protect workers, consumers and the environment.

The exchange, a transcript of which HuffPost obtained through a public records request, came at the start of a trial to determine whether Trader Joe’s violated workers’ rights. Trader Joe’s’ attorney, Christopher Murphy of the law firm Morgan Lewis, informed the judge, Charles Muhl, that there was “one final thing” the grocery chain wanted to add to its defense before proceedings began.

“The National Labor Relations Act as interpreted and/or applied in this matter, including but not limited to the structure and organization of the National Labor Relations Board and the agency’s administrative law judges, is unconstitutional,” Murphy said.

Fortunately, the judge (being a rational person) isn't going to be ruling on the Trader Joe's lawyer's claim, which seems to be part of a broader push by right- wingers in general and a certain Master of the Universe in particular:

Trader Joe’s does not appear to have expanded on the defense yet during trial, and there are no briefs yet laying out its logic. But the company may be using an argument similar to one recently made in federal court by SpaceX, Elon Musk’s rocket company, which NLRB prosecutors have also accused of labor law violations.

SpaceX claims that the NLRB violates the constitutional separation of powers as well as the right to due process, calling the board “the very definition of tyranny,” as Politico recently reported.

Like Trader Joe’s, SpaceX is represented by Morgan Lewis. The firm is known for its management-side work helping employers battle unions. Some of its highest-profile attorneys came out of the NLRB and served as conservative board members.

Here's what the NLRB has been doing for most of its nearly 90 years in existence:

The NLRB is an independent federal agency that was created to protect workers’ rights and foster labor peace. It has both a prosecutorial office, which brings cases against employers and unions, and a 5-member board, which interprets the laws governing bargaining in the private sector. The agency’s administrative law judges issue rulings that can be appealed to the 5-member board for review.

The agency’s constitutionality was upheld by the Supreme Court in 1937, two years after it was created. However, these days, the court’s conservative supermajority has been chipping away at the regulatory state. (SpaceX’s claims track with some of the arguments made in a case involving the Securities and Exchange Commission that’s currently before the Supreme Court, SEC v. Jarkesy.)

The attorneys representing Trader Joe's union wonder if the company knows who its legal and political bedfellows are;  we think it would be hard to believe they don't.  But, it's puzzling because they're *generally perceived* as consumer-sensitive and -friendly, and more left of center than not, contributing far more to Democrats than Republicans in every election cycle since 2004. But, rather than speculate on motives or tactics, actions speak louder than words, an idiom that applies not just for Trader Joe's management, but for its customers as well.  Costco anyone?

Biden's Border Challenge To Obstructing MAGAts

The Malignant Loser would like nothing better than to sabotage the teetering bipartisan border deal being negotiated in the Senate. He wants his racist, red meat immigration issue back for the 2024 elections and to deny President Biden a compromise win at the expense of addressing an emergency. An added bonus for the Malignant Loser is to make his ally Putin's job easier in Ukraine by withholding aid to the brave Ukrainians, aid which MAGA Republicans cynically have tied to a border bill (along with aid to Israel).

In a response to MAGA obstruction, President Biden stated yesterday that the proposed Senate deal would allow him to shut the border down when the situation became overwhelming, calling their bluff:

“It would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”

Biden's position reflects concern expressed by key Democratic legislators and big city mayors who have been absorbing large influxes of immigrants, often bused there by posturing MAGA governors like the vile Governors Greg Abbott of Texas and Ron "Bootsie" DeSantis of Florida. The Malignant Loser's sabotage was publicized widely, making it dangerous for MAGAts to claim bad faith by the White House and Dems. By showing that he's ready to take action on the border immediately with the authority of new legislation, Biden has put the ball back in the MAGA Republican's court to do something other than obstruct for the benefit of their cult leader, who wants to sow his usual chaos.

What's That Musk-y Smell? Stock Drops And Recalls

News this week that Tesla, the crashing car EV company owned by right-wing anti-Semite Elon Musk, had suffered a significant 40% drop in earnings has led to a 12% drop in shares, translating to a wipe out of $80 billion in market value for Musk's company, CNN reports:

"Tesla’s stock suffered its worst day in 21 months and closed at its lowest level since December 2022. Since the start of 2024, the company’s market capitalization has fallen by $210 billion.

In an earnings presentation Wednesday, the world’s most valuable automaker said its sales growth this year 'may be notably lower' than last as it continued developing the 'next-generation' vehicle, likely a lower-priced model. [snip]

Dan Ives, an analyst with market research firm Wedbush, said Tesla’s earnings call provided investors with 'minimal answers' to the company’s shrinking margins. 'We were dead wrong expecting Musk and team to step up like adults in the room on the call and give a strategic and financial overview of the ongoing price cuts, margin structure, and fluctuating demand,' he wrote in a note Thursday."  (our emphasis)

The same erratic and arrogant Musk that bought Twitter proceeded to run it into the ground, losing approximately 72% of its value since he purchased it in October, 2022.

In more bad news for Musk, Tesla is recalling 200,000 vehicles in the U.S. due to a software problem with its rearview camera. Last month, Tesla recalled 2 million vehicles over a problem with the Autopilot system that failed to alert drivers who were failing to pay attention. Sounds like a problem that Musk shares with his Autopilot system.

Trump Dead-Ender Navarro Sentenced

As referenced by Stephen Colbert below, one of the worst Trump dead- enders got a taste of justice yesterday:

Trump White House official Peter Navarro, who was convicted of contempt of Congress for refusing to cooperate with a congressional investigation into the Jan. 6, 2021, attack on the U.S. Capitol, was sentenced on Thursday to four months behind bars.

He was the second Trump aide convicted of contempt of Congress charges. Former White House adviser Steve Bannon previously received a four-month sentence but is free pending appeal.

Navarro was found guilty of defying a subpoena for documents and a deposition from the House Jan. 6 committee. He served as a White House trade adviser under then-President Donald Trump and later promoted the Republican’s baseless claims of mass voter fraud in the 2020 election he lost to Democrat Joe Biden.

U.S. District Judge Amit Mehta told Navarro that it took “chutzpah” for him to assert that he accepted responsibility for his actions while also suggesting that his prosecution was politically motivated.

“You are not a victim. You are not the object of a political prosecution,” the judge said. “These are circumstances of your own making." [snip]

Mehta said that asserting executive privilege is not “magic dust to avoid a duty."

“It's not a get-out-of-jail-free card,” the judge added...

Navarro is a nasty piece of work, with an academic sheen belying an aggrieved, eccentric world view. He was among the White House staffers most actively involved in the coup plot and its lead-up (a decent summary of his efforts here, not surprisingly under "Attempts to overturn the 2020 election").  In a more perfect world, he and his co- conspirators would be charged with sedition, like some of the sad sacks who attacked the Capitol on January 6, believing these nuts were telling them the truth.
